Terms and Conditions:

These Terms and Conditions (“Terms”) govern your use of services provided by Ecolegacy Africa, including all bookings, tours, safaris, and related travel products. By confirming a booking with us, you (“the Client”) agree to be legally bound by these Terms.

1. Booking and Payment

A non-refundable deposit of 30% of the total tour cost is required to confirm a booking, unless a different amount is specified in your tour agreement. The remaining balance is due at least 30 days prior to the safari start date. For bookings made less than 30 days before departure, full payment is required at the time of booking. Payments can be securely made via bank transfer, credit card, or other methods pre-approved by Ecolegacy Africa.

2. Cancellations and Refunds

a) By the Client: All cancellation requests must be made in writing via email. The following refund policy applies based on the date of our receipt of your cancellation notice:

  • More than 60 days before departure: A full refund will be issued, minus any non-refundable deposits and bank charges incurred.

  • 30-59 days before departure: A refund of 50% of the total tour cost will be processed.

  • Less than 30 days before departure: No refund will be provided.

b) By Ecolegacy Africa: We reserve the right to cancel a tour due to unforeseen and uncontrollable circumstances such as natural disasters, political instability, or events that would compromise the safety of our clients. In such a scenario, Ecolegacy Africa will offer the Client a choice between a full refund of all payments received or the option to reschedule the tour for a future date.

3. Travel Insurance

It is a strict requirement that all clients possess comprehensive travel insurance. This insurance must provide adequate coverage for medical emergencies, trip cancellations or interruptions, personal liability, and loss or damage to personal belongings. Ecolegacy Africa is not responsible for any costs, losses, or expenses that may arise from a Client’s lack of adequate insurance coverage.

4. Health and Safety

Clients are responsible for ensuring they are in good health and physically capable of participating in all activities included in their itinerary. It is mandatory to inform Ecolegacy Africa of any existing medical conditions, physical limitations, or special dietary requirements prior to travel. While Ecolegacy Africa adheres to strict safety protocols, we cannot be held liable for injuries, illnesses, or incidents resulting from a Client’s own negligence, failure to follow instructions, or unexpected encounters with wildlife.

5. Visas, Passports, and Documentation

It is the sole responsibility of the Client to ensure they possess a valid passport, all necessary visas, and any other required travel documents for entry into Tanzania and any other countries on their itinerary. Ecolegacy Africa will not be held responsible for any travel delays, denied entry, or financial losses incurred due to a Client’s failure to secure the correct documentation.

6. Itinerary Changes and Flexibility

Ecolegacy Africa commits to delivering the agreed-upon itinerary to the best of its ability. However, we reserve the right to make necessary and reasonable modifications to the itinerary due to factors beyond our control, including but not limited to adverse weather, road conditions, park regulations, or unforeseen operational issues. Any changes will be made with the Client’s safety and the overall quality of the experience as our top priority.

7. Liability Disclaimer

Ecolegacy Africa acts as an agent for our clients and holds no liability for any loss, damage, injury, or death that occurs during your trip, unless directly caused by our proven negligence. We are not responsible for delays, cancellations, or losses caused by the actions or negligence of third-party service providers, including airlines, hotels, or independent contractors. We are also not liable for losses or damages resulting from force majeure events, such as natural disasters, wars, or acts of terrorism.

8. Use of Images and Testimonials

Ecolegacy Africa may capture photographs or videos during your tour for promotional purposes, including use on our website, social media channels, and marketing materials. By booking with us, you grant us permission to use these images. Should you prefer not to be included in any promotional content, please inform us in writing before your tour begins.

9. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes arising from these Terms or our services shall be submitted to the exclusive jurisdiction of the courts in Tanzania.

10. Acceptance of Terms

By submitting your booking and payment to Ecolegacy Africa, you confirm that you have read, understood, and agreed to all of the above Terms and Conditions.
